1. Acceptance of Terms

Welcome to the KESUG School Results Management System ("the System," "we," "our," or "us"). By accessing or using the System, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

If you do not agree to these terms, you are not authorized to use the System and must discontinue use immediately.

2. Authorized Users

The System is exclusively for use by authorized personnel of registered educational institutions, including:

• School Administrators: Manage school settings, users, and oversee all academic operations.
• Teachers: Enter and manage examination results for their assigned subjects and classes.
• Students: View their own academic results and progress.
• Super Administrators: Manage multiple schools and system-wide settings.

Access is granted solely by school administrators or super administrators. You may not share your login credentials with any unauthorized person.

3. Account Security

You are responsible for:

• Maintaining the confidentiality of your username and password
• All activities that occur under your account
• Immediately notifying your administrator of any unauthorized use
• Ensuring you log out after each session, especially on shared devices

We reserve the right to disable any account at any time if we suspect a breach of security or violation of these terms.

4. Prohibited Activities

You agree NOT to:

• Use the System for any illegal purpose or in violation of any applicable laws
• Share your login credentials with unauthorized individuals
• Attempt to gain unauthorized access to other users' accounts or data
• Upload, transmit, or distribute any malicious code, viruses, or harmful content
• Attempt to bypass, disable, or interfere with security features
• Use automated scripts, bots, or scraping tools to access the System
• Modify, delete, or tamper with data without proper authorization
• Impersonate another user or misrepresent your identity
• Use the System to harass, abuse, or harm others

Violation of these terms may result in immediate account suspension or termination and may be reported to relevant authorities.

5. Intellectual Property

The KESUG School Results Management System, including its design, code, logo, and all content, is the exclusive property of KESUG Educational Services and is protected by copyright and intellectual property laws.

You may not:

• Copy, modify, or create derivative works of the System
• Reverse engineer, decompile, or attempt to extract the source code
• Remove any copyright notices or proprietary markings
• Use our name, logo, or branding without prior written permission

Schools retain ownership of their own data, including student records, teacher information, and academic results.

6. Data Ownership and Use

School Data: Each school owns the data entered into the System by its authorized users. We act as a data processor on behalf of the school.

Student Data: Student academic records are owned by the respective school. Students have the right to access their own records.

Teacher Data: Teacher information is owned by the respective school.

We do not claim ownership of your data. We only use your data to provide and improve the System's services.

7. Accuracy of Results

While we strive to ensure the System accurately records and calculates results:

• Teachers are responsible for entering accurate marks and grades
• School administrators are responsible for verifying and publishing results
• Students should report any discrepancies to their teachers immediately

We are not liable for errors resulting from incorrect data entry by users. Official academic records maintained by the school take precedence over System-generated reports.

8. Disclaimer of Warranties

THE SYSTEM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the System will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information obtained through the System

We do not guarantee that the System will always be available or free from errors. We reserve the right to perform maintenance that may temporarily affect availability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KESUG EDUCATIONAL SERVICES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your data
• Errors or omissions in any content or results

Our total liability shall not exceed the amount paid by your school for access to the System in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless KESUG Educational Services, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the System
• Your violation of these Terms of Service
• Your violation of any third-party rights
• Any content you submit or data you enter into the System

11. Termination

We reserve the right to suspend or terminate your access to the System at any time, with or without cause, including but not limited to:

• Violation of these Terms of Service
• At the request of your school administrator
• Extended period of inactivity
• Suspension of your school's subscription or account

Upon termination, your right to access the System will immediately cease. Data retention will be handled according to our Privacy Policy and applicable laws.

12. Modifications to Terms

We may modify these Terms of Service at any time. Changes will be effective immediately upon posting. The "Last Updated" date at the top indicates when changes were made.

Your continued use of the System after changes constitutes acceptance of the modified terms. It is your responsibility to review these terms periodically.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to conflict of law principles.

Any disputes arising from these terms or your use of the System shall be subject to the exclusive jurisdiction of the courts of Tanzania.
